Terms of Service
& EULA.
The agreement between you and Gymifi for using the app. This also serves as the End User License Agreement required by Apple.
These Terms of Service ("Terms") constitute a legally binding agreement between you and Gymifi ("we," "our," or "us") governing your use of the Gymifi mobile application ("App"). These Terms also serve as the End User License Agreement (EULA) required by Apple for apps distributed on the App Store.
Acceptance of Terms
By downloading, installing, or using the Gymifi App, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not download or use the App.
These Terms apply to all users of the App, including free trial users and paying subscribers. Your continued use of the App after any updates to these Terms constitutes acceptance of the revised Terms.
Description of Service
Gymifi is a fitness tracking and guidance application designed specifically for gym beginners. The App provides:
- Structured 12-month workout programs (Full Body, Push-Pull-Legs, Bro Split)
- Set, rep, and weight tracking with rest timers and progressive overload suggestions
- Indian diet plans (vegetarian and non-vegetarian) for bulking and cutting
- Body measurement and progress photo tracking
- Gamified ranking system from Stone to Master across nine ranks, with badges and streaks
- Achievement system with points and workout streaks
- Apple HealthKit integration (optional) for health data sync
Gymifi is a fitness guidance tool, not a medical service. The App does not provide medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before starting any new exercise or nutrition program.
Eligibility
- You must be at least 13 years of age (or 16 in the EEA) to use the App.
- If you are between 13 and 18, you must have parental or guardian consent.
- By using the App, you represent that you meet the applicable age requirement.
- The App is intended for personal, non-commercial use only.
User Accounts
Registration
- You must create an account to access most features. You may register with an email and password or use Sign in with Apple.
- You agree to provide accurate, current, and complete information during registration.
- You are responsible for maintaining the confidentiality of your account credentials.
Account Responsibility
- You are solely responsible for all activity that occurs under your account.
- Notify us immediately at gymifiapp@gmail.com if you suspect unauthorized access.
- We reserve the right to suspend or terminate accounts that violate these Terms.
- You may not share your account with others or create multiple accounts.
Account Deletion
You may delete your account at any time from Settings → Account → Delete Account. Deletion permanently removes your data in accordance with our Privacy Policy.
License & Intellectual Property
License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple-branded devices that you own or control, solely for your personal, non-commercial fitness tracking purposes.
Restrictions
You may not:
- Copy, modify, or distribute the App or any part of it
- Reverse engineer, decompile, or disassemble the App
- Rent, lease, lend, sell, or sublicense the App
- Remove or alter any proprietary notices or labels on the App
- Use the App to build a competing product or service
- Scrape, crawl, or extract data from the App by automated means
Our Intellectual Property
The App, including all content, features, workout programs, diet plans, design, graphics, and code, is owned by Gymifi and protected by applicable intellectual property laws. All rights not expressly granted are reserved.
Apple EULA
As required by Apple, this EULA is between you and Gymifi only, not with Apple. Apple is not responsible for the App or its content. In the event of any conflict between these Terms and the Apple Media Services Terms and Conditions, the Apple terms will prevail only to the extent of the conflict.
Subscriptions & Payments
Pricing
Gymifi offers three subscription options. Current prices are displayed in the App and on the App Store at the time of purchase, and may vary by region:
- Monthly Plan: billed monthly — full access to all features, cancel anytime.
- Yearly Plan: billed once a year — full access to all features.
- Lifetime Plan: a one-time payment — permanent access including all future updates.
Billing & Payment
- All payments are processed through Apple In-App Purchase. Gymifi does not directly handle payment card information.
- Your Apple ID account will be charged upon confirmation of purchase.
- Auto-renewing subscriptions renew unless cancelled at least 24 hours before the end of the current period.
- Subscription management and cancellation is done via your Apple ID settings: Settings → [Your Name] → Subscriptions.
Refunds
All purchases are final and processed by Apple. Refund requests must be submitted to Apple directly via reportaproblem.apple.com. Gymifi does not independently issue refunds for App Store purchases. Apple's refund policies apply.
Price Changes
We may change subscription prices at any time. Price changes will not affect your current billing period. We will notify you in advance of any price changes. Your continued subscription after the price change takes effect constitutes acceptance of the new price.
Free Trial
- New users receive a 7-day free trial with full access to all App features.
- No credit card is required to start the free trial.
- You will not be automatically charged at the end of the free trial. The App will pause until you choose a subscription plan.
- Your data is preserved during and after the trial period.
- Free trial eligibility is determined by Apple and may vary by region or Apple ID history.
- We reserve the right to modify or discontinue free trial offers at any time.
Acceptable Use
You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the App in any way that violates applicable local, national, or international laws or regulations
- Transmit any unsolicited or unauthorized advertising or promotional material
- Attempt to gain unauthorized access to any part of the App or its related systems
- Introduce any viruses, trojans, or other malicious code
- Use the App to harm, harass, or intimidate any person
- Impersonate any person or entity, or falsely represent your affiliation with any person or entity
- Interfere with or disrupt the integrity or performance of the App
User-Generated Content
The App allows you to create and store personal content including workout logs, body measurements, progress photos, and custom notes ("User Content").
Your Content
- You retain ownership of all User Content you create within the App.
- You grant Gymifi a limited license to store and process your User Content solely to provide the service to you.
- You are responsible for ensuring your User Content does not violate any third-party rights.
- We do not access, view, or use your User Content except as described in our Privacy Policy.
Content Standards
- Progress photos and other content you upload must comply with Apple App Store guidelines.
- You must not upload content that is illegal, offensive, or infringes third-party rights.
- We reserve the right to remove any content that violates these standards.
Health & Safety Disclaimer
Gymifi provides fitness information and workout guidance for educational purposes only. The App is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider before beginning any exercise program or making changes to your diet.
- Stop exercising immediately and consult a doctor if you experience pain, dizziness, shortness of breath, or any other unusual symptoms.
- The workout programs and diet plans in the App are general guidelines and may not be appropriate for all individuals.
- Results vary based on individual effort, body type, consistency, and other factors. We make no guarantees regarding specific outcomes.
- By using the App, you acknowledge that physical exercise involves inherent risks. You assume full responsibility for any injury or health issue that arises from following the App.
- If you have a pre-existing medical condition, consult your physician before using Gymifi.
Disclaimers & Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
- We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
- We do not warrant the accuracy, completeness, or usefulness of any information provided in the App.
- We are not responsible for any third-party services connected to the App, including Apple HealthKit.
- Features and content in the App may be updated, modified, or removed at any time without notice.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GYMIFI, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, data, or goodwill
- Personal injury or property damage arising from your use of the App
- Any unauthorized access to or use of our servers or personal information stored therein
- Any interruption or cessation of transmission to or from the App
- Any bugs, viruses, or the like transmitted through the App
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO GYMIFI IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR THE THEN-CURRENT PRICE OF A ONE-MONTH SUBSCRIPTION, WHICHEVER IS GREATER.
Apple has no warranty or liability obligation with respect to the App. Any maintenance and support for the App is provided by Gymifi, not Apple. Apple is not responsible for addressing any claims by you or any third party relating to the App.
Termination
Termination by You
You may stop using the App and delete your account at any time from Settings → Account → Delete Account. Cancelling a subscription does not automatically delete your account.
Termination by Us
- We may suspend or terminate your access to the App immediately, without prior notice, if you violate these Terms.
- We may also discontinue the App or any part of it at any time.
- Upon termination, your license to use the App ceases immediately.
Effect of Termination
- Sections that by their nature should survive termination (Intellectual Property, Disclaimers, Limitation of Liability, Governing Law) will survive.
- We will handle your data upon account deletion in accordance with our Privacy Policy.
- No refund is due for unused subscription time upon termination for cause.
Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
Dispute Resolution
- We encourage you to contact us first at gymifiapp@gmail.com to resolve any disputes informally.
- Any disputes not resolved informally shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India.
- Notwithstanding the above, we may seek injunctive or equitable relief in any court of competent jurisdiction.
Third-Party Claims
In the event of any third-party claim that the App or your use of the App infringes a third party's intellectual property rights, Gymifi (not Apple) is solely responsible for the investigation, defense, settlement, and discharge of any such claim.
Changes to These Terms
- We may update these Terms from time to time. We will update the "Last Updated" date when changes are made.
- For material changes, we will provide at least 30 days' notice via in-app notification and/or email before the changes take effect.
- Your continued use of the App after the effective date of revised Terms constitutes your acceptance.
- If you do not agree to the updated Terms, you must stop using the App and may request account deletion.
